Late Friday evening, as the rest of the country was wrapping things up for the weekend, one judge in Texas succeeded in shocking everyone to attention with one 'tiny' ruling.
The Affordable Care Act - the mandatory health insurance initiative had been hailed as a major victory for the left. With all Americans required to purchase health care, they took it as a referendum on socialized health care. But now, that's all about to change.
Breitbart is reporting, ”Judge Reed O’Connor, a U.S. District Judge for the Northern District of Texas appointed by former President George W. Bush, ruled that Obamacare violated the Constitution.”
The ruling comes at the conclusion of a case brought before the court asking the judge to rule the Affordable Care Act unconstitutional.
"Twenty Republican state attorneys general brought the suit, Texas v. Azar, who asked the court to rule that the Affordable Care Act (ACA) violates the Constitution after Republicans managed to zero out Obamacare’s individual mandate penalty with the Tax Cuts and Jobs Act last year.
“The judge ruled that the law’s individual mandate violates the Constitution and therefore the entire ACA violates the Constitution.”
Not one to mince words, President Trump took to Twitter to declare this victory:
“As I predicted all along, Obamacare has been struck down as an UNCONSTITUTIONAL disaster! Now Congress must pass a STRONG law that provides GREAT healthcare and protects pre-existing conditions. Mitch and Nancy, get it done!”
Pundits on both sides of the aisle have cried out about the decision. And, depending on who you are, they are crying out with either outrage or jubilation.
Conservative influencers are cheering the decision, while still acknowledging that the decision will almost certainly face an appeal.
Some are pointing out that Obama’s legacy is about to be annihilated.
“If indeed ObamaCare were to be ruled unconstitutional by the appellate courts and, finally, the Supreme Court, Obama’s legacy would, at last, be wiped clean. It would be as if he never existed.”
Meanwhile, liberals are freaking out, rushing to spin the story so that Mr. Trump looks as bad as possible and accusing the judge of waiting until after the November election to serve a political agenda.
Others resort to scare tactics and gross exaggeration:
“A federal judge in Texas threw the health coverage of some 20 million Americans in limbo late Friday by ruling Obamacare must be scrapped.”
So what does that mean for the millions of Americans who now pay for policies through the ACA? Well, it’s not over yet, although the ruling is a positive sign. ACA is still the law of the land and subscribers should continue to enroll before tomorrow’s deadline.
So, no matter which side of this issue you come down on, one thing is for sure. Those who thought Obamacare was a done deal, now have to face what conservatives have been saying all along. Now we just have to wait and see how the appellate court and, finally, the Supreme Court think.
