It’s been a long road, but a judge has finally made the decision that has been under dispute for several months. Beloved comedian and actor Tim Conway, 85, who has been in declining health over the past few years, was the object of a family dispute over who should make vital decisions for the incapacitated funnyman.
According to court documents obtained by People, on Tuesday, “Conway’s wife Charlene was appointed conservator of her husband after the court found ‘clear and convincing evidence’ that a conservatorship of Conway was necessary.
"Charlene was found to be ‘suitable and qualified’ by the court, and Conway consented to her appointment.”
According to the filing, Conway, 85, is “unable to make his own healthcare decisions.”
Six months ago, we reported that the “beloved funnyman, Tim Conway, 84, best known for his many memorable appearances on ‘The Carol Burnett Show’ is reportedly in very poor health, suffering from dementia and unable to care for himself.”
The family controversy arose out of a difference in opinion between Conway’s present wife and his seven children by his first wife.
His daughter, Kelly 57, speaking on behalf of her siblings was “asking the court to control his medical care because his current wife is trying to move him out of the facility he is in.”
Kelly’s concern was that her stepmother Charlene would move her father to a facility that was not adequate for the level off care he needs.
Kelly also stated that Conway could not “properly provide for his personal needs for physical health, food, and clothing” and is “almost entirely unresponsive.”
People magazine offered additional details, “Kelly, 56, filed the documents in Los Angeles on Friday, [August 24th] claiming Conway’s wife Charlene is ‘planning to move him out of the excellent skilled nursing facility he is currently at’ and place him in one that won’t give him access to ‘registered nurses at all times and his 24-hour caregiver and speech therapist (to help with swallowing)'."
At that time, Kelly was granted a temporary order of protection, preventing Charlene from moving Mr. Conway. Then, one week later, Charlene appeared in court to state her case.
Mrs. Conway said, at the time, she did not believe her husband needed a conservator appointed, but if one were, it should be her. the judge agreed; no conservatorship was ordered at the time.
Now, after six additional months of Conway's declining health, it appears time for that to change; a judge has decided in Charlene’s favor, ruling that Charlene would make all future medical care decisions on her husband's behalf. No word on Kelly's reaction to the news.
According to People, “Charlene is Conway’s second wife. The veteran actor was previously married to Kelly’s mother Mary Anne Dalton from 1961-78. (In addition to Kelly, they share daughter Jackie and sons Jaime, Tim Jr., Pat, Corey and Shawn.)
